RI repeals law that made it a crime to fib online

(AP) ? If you've ever lied to a potential Internet date about your weight, texted your spouse that you were someplace you weren't or emailed mom to say how much you love that ugly new sweater, you were breaking the law if you did it in Rhode Island.

But state lawmakers have now decided that white lies online should no longer be a crime. The General Assembly voted this month to repeal an obscure 1989 law that made fibbing on the Internet a misdemeanor punishable by fines of up to $500 and as much as a year in prison. Gov. Lincoln Chafee signed the measure.

"This law made virtually the entire population of Rhode Island a criminal," said Steven Brown, executive director of the Rhode Island American Civil Liberties Union. "When this bill was enacted nobody had any idea what its ramifications were. Telling fibs may be wrong, but it shouldn't be criminal activity."

The law ? which legal experts say was unusually broad compared to similar laws across the country ? was written to stop fraud, con artists and scammers, but it also outlawed the "transmission of false data" regardless of whether liars stood to profit from their deception or not.

Only a handful of people were ever prosecuted for lying online, but legislators said it made no sense to keep a law on the books that is violated so often by so many people. Rep. Chris Blazejewski, who proposed eliminating the law, said it was likely unconstitutional.

Lies may make you a scoundrel, cost you a relationship or get you fired, but they shouldn't make you a criminal unless you're trying to commit fraud or some other offense, he said.

"There are a lot of things we don't condone in our society that aren't crimes," Blazejewski said. "We take freedom of speech very seriously in this country and we should be concerned about the real and serious possibility of further erosion to our First Amendment civil liberties."

While the right to lie about your waistline is not spelled out in the Bill of Rights, even despicable speech must be protected, according to Jonathan Turley, a law professor at George Washington University. Although Rhode Island's former law is unusual around the nation, Turley said a federal law making it illegal to lie about receiving top military honors brings up similar First Amendment questions. The U.S. Supreme Court could rule this week on that law, called the Stolen Valor Act.

"It's part of human nature to embellish and at times lie," Turley said. "It's not a redeeming characteristic maybe but it's a common one. When you give the government the power to criminalize lies, you give it the power to determine what is true and what is false, and which lies to prosecute. That's a dangerous tool."

The repeal of the Rhode Island law was prompted in part by a 2010 case in which a former prison guard was arrested for setting up a fake Facebook page in the name of his boss, the state's corrections director. The charges were later dropped, though the guard lost his job. The man's attorney, John Grasso, said what his client was accused of doing "may not be bright, but it shouldn't be illegal."

"Everybody lies online," Grasso said. "You shouldn't be dragged into court and told that you can't tell people you're 6 feet tall when you're not."

Yes, the robot cheats. By watching the image from a camera that can determine the position of your hand every millisecond, it is aware of your move the very moment you make it. And as soon as your hand starts to form that rock, the robot is giving you some paper to wrap it up. At the very end of the video, you can see the tiny delay between the human making a move and the robot reacting ?? but it happens so fast that you wouldn't notice except when shown in slow-motion.

Doesn't seem fair, does it? But since humans can't see or react on a millisecond timescale, such a tactic would never even be considered. It's precisely because reaction time doesn't come into it that rock-paper-scissors?becomes a game of psychology or dumb luck. Similarly, our vision isn't good enough to read a person's cards in the reflection of their eyes, and we're not skillful enough with our hands to control the outcome of dice.

Robots, on the other hand, could be fast enough, far-sighted enough, or precise enough that they could do any of those things. In this case, the robot can think and react in the time it takes you to make your play. Sure it's cheating ?? but it's still quite a trick.

The lab built the setup to show how quickly a robot arm and vision system could accommodate human input; that hand could just as easily be remotely operating in a hostile area or amplifying those movements to pick up construction materials. When people think of Nevada, often times the first thing that comes to mind is Las Vegas -- and for good reason. It's the Entertainment Capital of the World and home to the best casinos, restaurants and hotels that you'll find anywhere. But Nevada is a land of many incredible treasures and among them is the great city of Reno, the "Biggest Little City in the World."

Later this month, Bowling's U.S. Women's Open will come to Reno, bringing together two of our country's great treasures -- and two classic American comeback stories.

I see a fascinating parallel between Reno and bowling. Bowling is a sport that some thought had seen its heyday. After explosive growth during the 1950s and 60s, the bowling industry cooled off during the late 1980s and early 90s and some thought that it was a pastime whose time had passed. Boy were they wrong. In recent years, bowling has seen an incredible resurgence, fueled by the emergence of entertainment bowling centers that offer a more upscale experience including lounge areas and restaurant quality food. Bowling is now the nation's number one participatory sport with more than 71 million people taking to the lanes annually (more than 832 million games played every year) and the sport is seeing surging popularity among female and youth audiences. In fact, bowling now competes with hockey as one of the nation's fastest growing high school sports.

Similarly, the city of Reno is an incredible turnaround story. Reno had a series of ups and downs in the early 20th century and after gas explosions rocked the city in the late 1950s, Reno went through some tough times. However, years of hard work and investment have paid off and today Reno is flourishing. With a population of more than 225,000, Reno is the largest city in Northern Nevada and home to a growing economy and rapidly developing cultural center. There is now just so much going on in Reno... the River Walk District, Nevada Museum of Art, the Triple A Reno Aces, the Reno Championship Air Races... not to mention breathtaking views of the majestic Sierra Nevada mountains and easy access to Lake Tahoe, one of the most gorgeous places on the planet.

In just a few short weeks, the finals of the Bowling's U.S. Women's Open will be played underneath the iconic Reno arch on Virginia Street nearby the Eldorado Hotel Casino. It will be an incredible outdoor sports experience that will break new ground for bowling. More than 300 competitors from over 16 countries will compete with a chance to win a million dollars if a perfect 300 is rolled in the finalist competition, which will be aired on ESPN2.

I'll be candid -- bowling is good business. The economic benefit of hosting the U.S. Women's Open in Reno is significant. It's estimated that the event will bring several thousand tourists to the area and create a groundswell of national publicity for Reno. And I'm just so glad that Reno was selected as the host city for this spectacular sporting event.

Like bowling, Reno is a great American comeback story that deserves to be told. On the eve of June 27th, as the finals of Bowling's U.S. Women's Open will be played under the Reno Arch, two of America's great treasures will be brought together for an incredible sports viewing experience. Talk about a win-win.

Mexico captures suspected son of top gang boss

MEXICO CITY - Jesus Alfredo Guzman, to be the son of Mexico?s most wanted drug gang boss ?El Chapo,? it believed to have been captured, officials in the country said Thursday.

A man suspected to be Jesus Alfredo was held in the western state of Jalisco on Thursday morning, the Navy said in a statement.


His father Joaquin Guzman - nicknamed ?Shorty,? or "El Chapo" in Spanish - escaped a Mexican jail in a laundry cart in 2001 and runs the Sinaloa cartel, arguably the country's most powerful gang.?

Drug violence in Mexico has exploded over the last decade, and there have been more than 55,000 drug-related killings since President Felipe Calderon took office in December 2006.?

One killed every half hour in Mexico drug-related violence

Thursday's arrest comes just over week before Mexico votes for a new president. The ruling National Action Party has lost support due to the drug violence ravaging the country. The constitution bars Calderon from running for re-election.?

A video "mockumentary" that shows children as kidnappers, corrupt cops and drug traffickers sparked a fierce debate in violence-torn Mexico. Msnbc.com's Dara Brown reports.

The U.S. Treasury said last month Americans were banned from doing any business with two of Guzman's sons, who were identified as Ivan Guzman and Ovidio Guzman, under the terms of the Foreign Narcotics Kingpin Designation Act.?

Pilot Andre Borschberg attempted the same flight on June 14 but had to turn back after unexpectedly strong winds buffeted the slow moving plane and sent it reeling backwards.

The plane flew from Switzerland to Morocco to publicize the possibilities of solar power and highlight the North African country's own solar power plans.

PFT: 'I think Tony Romo is an elite quarterback'

Maybe it really wasn?t Anthony Hargrove?s voice saying, ?Give me my money.?

The video/audio of a comment supposedly made by the former Saints defensive end during the third quarter of the 2009 NFC title game provides further proof of Drew Brees? point (even if it wasn?t articulated the best way possible) that the media has more power than anyone realizes.

The NFL, however, fully realizes.

And the NFL used the power of the media to make millions believe on Monday that Saints defensive Anthony Hargrove said, ?Bobby, give me my money? after being told by assistant head coach Joe Vitt that Vikings quarterback Brett Favre may have suffered a broken leg in the 2009 NFC title game.

The seed was planted and fertilized when a dozen members of the media covering Monday?s appeal hearing received an invitation to witness an encore performance of former prosecutor Mary Jo White?s summary of evidence.? The relevant excerpt from the transcript of the media session contains White?s explanation, comments from NFL Security chief Jeff Miller, comments from NFL spokesman Greg Aiello, and two of the members of the media ? Peter King and Jim Varney.

White initially explained that the video contains Hargrove?s ?voice and picture.?? After the video was shown once to the members of the media, Aiello suggested that the media pay attention to Hargrove winking and smiling after hearing that Favre broke his leg.? White later claims that Hargrove ?smiles and winks and states, ?Bobby, pay me my money.??

White, perhaps not recognizing in that moment the ironic link to a very common lawyer joke, says, ?Because you can see his lips moving.?

But here?s the problem, and I didn?t notice this the first time I saw the video.?

When Hargrove?s lips can be seen moving, his voice can?t be heard.

Only after Hargrove?s face is fully obscured by the head and shoulders of defensive tackle Remi Ayodele are the words ?give me my money? audible.

No one has questioned this because the media present at the session was told ? and in turn told the rest of us ? that Hargrove said, ?Bobby, give me my money.?? Even Peter King, who seemed curious and a bit skeptical in the transcript, affirmatively stated twice in his article following the media session that Hargrove said what the NFL claims he said.

Watch the video.? At most, Hargrove is the one who says ?Bobby.?? By the time ?give me my money? comes out, Hargrove?s mouth and face and head are obscured by Ayodele.

Also, don?t forget that Hargrove didn?t apply the hit that resulted in Favre possibly having a broken leg.? Instead, Favre had been hit low by McCray and high by Ayodele.? So why would Hargrove be asking for any money at all?

None of this changes the fact that, barring evidence that the phrase was added artificially after the fact (I?m not saying it was . . . yet), someone said ?give me my money.?? Which supports the conclusion that there was a bounty on Favre.

But I don?t believe the video shown by the league to the media shows that Hargrove said it.? And I can?t believe that the NFL presumes conclusively that he said it.? And I can?t believe the NFL sold it as fact to the media.? And I can?t believe the media swallowed the hook.

And I can?t believe I didn?t pay close enough attention to figure it out before today.

And given Hargrove?s passionate denial that it?s his voice, I believe him.

This serious flaw in the presentation of the evidence necessarily undermines the league?s entire investigation, further reinforcing the importance of asking tough questions about the proof, the process, and all other aspects of the case.? Regardless of whether the players are guilty or innocent, the NFL has peddled to the public, via the media, a stream of inconsistencies, mischaracterizations, and embellishments that raise legitimate concerns about the competence and/or the motives of everyone whose fingerprints are on the file.

UPDATE 8:44 p.m. ET:? A prior version of this item explained that, when Hargrove?s lips are moving, his words aren?t audible.? I?ve studied the video several more times, and it now appears to me that Hargrove is the one who says, ?Bobby.?? However, by the time ?give me my money? is uttered, Hargrove?s face and head and mouth are obscured.? Thus, the video doesn?t prove who said it.? It could have been Hargrove.? It could have been Ayodele.? (It would make more sense if the league were claiming it was Ayodele, since he hit Favre high when ?Bobby? hit Favre low.)? It also could have been someone outside of view of the camera, talking about something completely unrelated to Favre?s apparently injury.

AT&T Toggle 2.0 service gives your smartphone a ... - Know Your Cell











AT&T on Monday introduced Toggle 2.0, a BYOD service that lets users and companies set up separate work and personal environments on a single device. The service is available now for Android smartphones running Android 2.2 Froyo and Android 2.3 Gingerbread.

Toggle 2.0 is the follow up to Toggle 1.0, an earlier version of the virtualization service the carrier unveiled late last year. With Toggle 2.0, however, users can have separate apps, accounts and even data and voice plans one one device. Toggle 2.0 is similar to VMWare's virtualization service, Horizon Mobile, but just a lot more advanced.

Addtionally, Toggle 2.0 also allows businesses to set up a customized App Store where users can download business applications approved for them. The previous version required administrators to push applications to the users' devices using the Android SDK.

AT&T's Toggle 2.0 joins a whole bevy of services in recent months trying to capitalize on the new BYOD trend in offices. VMWare's previously mentioned service also tries to do this, as well as Samsung's SAFE certification. Samsung's SAFE is a little different, of course, but is aiming to make all Galaxy S III handsets "enterprise-ready."

Overall, AT&T's Toggle 2.0 is a huge undertaking, but looks to be extremely useful and valuable for employers. I personally usually take a hostile attitude toward AT&T, but with Toggle 2.0 I am actually impressed. It will be interesting to see how it does, but there is definitely a market for it.

Again, Toggle 2.0 is availalbe now for Android and should arrive for iOS in just a few short weeks. Versions of the service will also be launching on BlackBerry and Windows Phone sometime near the end of 2012.

Should Roger Clemens Go Into Baseball's Hall Of Fame?

Now that Roger Clemens has been found not guilty of lying to Congress and obstructing its investigation into the use of performance-enhancing drugs by Major League Baseball players, the debate resumes about whether one of baseball's greatest pitchers should or shouldn't get into the sport's hall of fame.

USA Today talked with some of the baseball writers who vote on hall of fame nominees. The Boston Globe's Nick Cafardo says he was going to vote "for" Clemens before Monday's news about the verdict, and nothing's happened to change his mind. But Yahoo baseball columnist Tim Brown says "the facts of the case certainly led me to the opinion that Roger Clemens did in fact use performance-enhancing drugs. I won't vote for anyone that I believe enhanced his career by cheating. I won't vote for Clemens."

Clemens career stats are obviously impressive:

? 354 wins, the ninth-most.

? A record seven Cy Young awards, which honor baseball's best pitchers.

? 11 All-Star appearances.

It was also alleged, however, in the 2007 Mitchell Report, that as a New York Yankee, Clemens used steroids and human growth hormone. He has consistently denied ever using such performance-enhancing drugs. Washington Post columnist Mike Wise writes that "in many of our minds ... Roger Clemens is guilty ? guilty enough to never be enshrined in Cooperstown."

Next winter, as New York's Daily News says, Clemens' name will be on hall of fame ballots for the first time (he retired after the 2007 season) and the baseball writers who vote face a "very difficult decision." A player has to receive votes "on at least 75 percent of ballots cast" to get in the hall. If he isn't elected the first year he's eligible (you have to have been retired at least five years), there's always the chance to be elected in a subsequent year.

Which raises this question ? one that can also be asked about several other baseball superstars from recent years who have been linked to performance-enhancing drugs:

The last time we reviewed the MacBook Air, we didn't have a whole lot to compare it to. Sure, there was the original Samsung Series 9, but it was more expensive, at $1,649, and ran off a standard-voltage processor, often at the expense of battery life. Companies like Lenovo and Toshiba already had deep experience making ultraportables, but those notebooks generally weren't as light, or as skinny, as the Air. A year ago, too, Ultrabooks, as we now know them were little more than a concept as far as the computer-buying public was concerned.

Today, there are 110-plus Windows-based Ultrabooks on the horizon, leaving consumers with an overwhelming smorgasbord of thin, shockingly powerful laptops. Apple, for its part, has stuck with the same Air design we liked so much the first time around, though it's refreshed the lineup with speedier Ivy Bridge processors and traded those USB 2.0 ports for 3.0. Additionally, the Air can now be configured with more RAM and roomier storage. Oh, and the 13-inch version now starts at $1,200, down from $1,300. (The 11-inch version still goes for $999 and up.)

That sounds promising, making an already-excellent laptop faster and less expensive. Still, with so many comparable products on the Windows side, we have to wonder, does Apple really continue to define the category or have other companies narrowed the gap? Let's find out.
